There has been discussion in the "Shootings/unusual violence" thread and on the GT, on gun control, but I think it warrants its own thread. I'll start it off an article about the reaction to possible pending legislation on gun control from Texas.


Breaking news: Texas lawmakers to introduce law threatening felony arrest of any feds who attempt to enforce Obama's gun control orders

Texas state Rep. Steve Toth ( http://www.house.state.tx.us/news/press ... _code=2825 ) has just announced his intention to introduce a "Firearms Protection Act" into law which would make it a felony crime for anyone, including federal agents, to enforce Obama's anticipated gun control executive orders, including orders that attempt to limit the size of gun magazines.

"The Firearms Protection Act bill would make any federal law banning semi-automatic firearms or limiting the size of gun magazines unenforceable within the state's boundaries. Anyone trying to enforce a federal gun ban could face felony charges under the proposal," reads Steve Toth's website announcement.

"We can no longer depend on the Federal Government and this Administration to uphold a Constitution that they no longer believe in. The liberties of the People of Texas and the sovereignty of our State are too important to just let the Federal Government take them away. The overreach of the federal administrations executive orders that are do not align with the Constitution, are not very popular here in Texas."

Confirmed: Huge outpouring of support
I spoke with Rep. Toth's chief of staff Amy Lane this morning and confirmed the bill is being drafted by attorneys and that final language is expected by next Tuesday. The bill is roughly similar to the Firearms Protection Act that has already been introduced in Wyoming, and it would bar the state of Texas from using financial or personnel resources to engage in any sort of gun confiscation activity. It would furthermore make it a felony crime for any federal officer or employee to infringe on the constitutionally-protected gun rights of law-abiding Texas citizens.

The response to Rep. Toth's announcement has been gigantic. "We've been flooded with phone calls," Amy told me a few minutes ago. "We're even getting many calls from New Yorkers who are saying they're ready to leave the state and come to Texas."

President Obama is expect to announce 19 executive orders as early as tomorrow that would bypass Congress and impose unconstitutional and illegal restrictions on gun magazine capacity, the sales of rifles and much more. Resistance against Obama's gun grabbing schemes is growing by the day, all across America. Nowhere is this resistance more determined and vocal than in Texas, where the vast majority of citizens own and cherish their firearms for self defense, farming and ranching, and defense against tyranny.

Listed as House Bill 0104, the Firearm Protection Act is sponsored by eight House members and two Senators in the State of Wyoming. The bill is less than three pages long and begins:

“AN ACT relating to firearms; providing that any federal law which attempts to ban a semi-automatic firearm or to limit the size of a magazine of a firearm or other limitation on firearms in this state shall be unenforceable in Wyoming; providing a penalty; and providing for an effective date.”


It essentially re-creates a felony punishable by prison and fines for any agent (federal or local or even private gun dealer) who attempts to enforce an unconstitutional firearms law the infringes on Wyoming’s sovereign rights. Yes, I said “re-creates.” The law already exists, passed in 2010, and this law merely amends that to make the misdemeanor into a felony and adds “owned or” to the “owned or manufactured” provisions of the former law – which dealt exclusively with weapons made in Wyoming.

In other words, the law makes it a felony for anyone to attempt to enforce unconstitutional firearms laws on Wyoming citizens.

Federal Firearms License regulatory reform - enacted May 19, 1986,

Under the Gun Control Act of 1968, the Bureau of Alcohol, Tobacco and Firearms, now the Bureau of Alcohol, Tobacco, Firearms, and Explosives (BATFE) was given wide latitude on the enforcement of regulations pertaining to Federal Firearms License (FFL) holders. Allegations of abuse by ATF inspectors soon arose from the National Rifle Association (NRA) and certain targeted Federal firearms licensees.

In the Report of the Subcommittee on the Constitution of the Committee on the Judiciary, United States Senate, 97th Congress, Second Session (February 1982), a bipartisan subcommittee (consisting of 3 Republicans and 2 Democrats) of the United States Senate investigated the Second Amendment and reported its findings. The report stated:

The conclusion is thus inescapable that the history, concept, and wording of the second amendment to the Constitution of the United States, as well as its interpretation by every major commentator and court in the first half century after its ratification, indicates that what is protected is an individual right of a private citizen to own and carry firearms in a peaceful manner.[1]

It concluded that seventy-five percent of ATF prosecutions were "constitutionally improper", especially on Second Amendment issues.[2]

The Firearm Owners Protection Act of 1986 addressed the abuses noted in the 1982 Senate Judiciary Subcommittee report.

Mexico Jumps into the U.S. Gun Control Debate

A three-ton sign made of confiscated crushed weapons unveiled last year in Ciudad Juarez, Mexico, by then-President Felipe Calderón, sent a clear and direct message to American neighbors up north: “No More Weapons.”

For years, particularly under Calderón’s leadership, Mexico has directly blamed lax U.S. gun control laws for increased violence south of the border by arming Mexican drug cartels to with military-grade assault weapons. Calderón said the expiration of the U.S. assault weapons ban in 2004 directly coincided with a rise in violence in Mexico.

a new administration led by President Enrique Peña is trying to capitalize on the U.S. debate on stricter gun control, which has captured national attention following massacres in Aurora and Newtown. Peña has come out in public support of measures that would tighten up U.S. gun regulations.

Obama Considering Nineteen Executive Orders on Gun Control; Republicans Freaking Out

The Washington Post reports that Obama "will unveil a sweeping set of new gun-control proposals at midday Wednesday, including an assault weapons ban, universal background checks and limits on the number of bullets in weapons magazines," along with "a slate of up to 19 separate executive actions that the Obama administration can take on its own to attempt to limit gun violence." Both lawmakers and gun-control advocates have been invited to the announcement.

Biden reportedly met with House Democrats yesterday to outline a way forward, with a formal announcement from Obama on his plan expected later in the week. "It was all focusing on enforcing existing law, administering things like improving the background database, things like that that do not involve a change in the law but enforcing and making sure that the present law is administered as well as possible," said Representative Bobby Scott of Virginia about the meeting. "I think everybody acknowledges that the assault weapons ban is a challenge, but other things — like the size of the magazines, the background checks, straw purchases — are all things that have a good chance of passing."

"If the president is allowed to suspend constitutional rights on his own personal whims, our free republic has effectively ceased to exist." NRA's video game smacks of hypocrisy

(CNN) -- The nation has struggled with addressing how best to reduce gun violence following last month's tragic shooting in Newtown, Connecticut. Responding to calls for gun control, the National Rifle Association attempted to shift blame for mass homicides away from guns to cultural influences such as video games or entertainment. No one can accuse the NRA of not being clever. At least not until it released a gun-themed shooting game less than a month after condemning the video game industry.

In fairness, "Practice Range," rated for ages 4 and up and free on the iPhone and iPad, is no blood-soaked, first-person shooter game. The trailer shows that it allows the player to engage in target practice using realistic-looking weapons. One of the weapon options appears to be an AR-15, the same weapon used at Newtown. The game also includes some gun safety tips.

I have no objection to the game per se, although the NRA's app smacks of hypocrisy.

Releasing a gun-themed shooting video game a month after the Newtown massacre reveals that the NRA doesn't even take its own claims seriously. As for the NRA's assertion that games create violence, it is nakedly self-serving.

But, as queasy as the whole thing is, violent video games do not cause more violence. Several researchers, including myself, met with Vice President Joe Biden on Friday to inform him that studies are unable to support the contention that violent video games contribute to societal violence. Rather, it is untreated mental health symptoms that contribute to outcomes including youth violence, dating violence and bullying.

As Fareed Zakaria aptly noted, nations that consume more video games per capita than the United States such as Japan, or share our media culture almost identically such as Canada, have much lower violence rates than our country.

America's gun problem is not a race problem

(CNN) -- Massacres such as Newtown are horrifying and heart-rending. They are nothing like the typical American gun murder.

The typical murder has one victim, not many. The typical murder is committed with a handgun, not a rifle. And in the typical murder, both the perpetrator and the victim are young black men. Blacks are six times as likely as whites to be the victim of a homicide. Blacks are seven times as likely to commit a homicide.

The horrifying toll of gun violence on black America explains why black Americans are so much more likely than whites to favor gun control.

Conversely, fears of being victimized by violence explain why so many white Americans -- especially older and more conservative white Americans -- insist on the right to bear arms in self-protection. They see gun violence as something that impinges on them from the outside. They don't blame guns for gun violence. They blame a particular subset of the population. And they don't see why they should lose their right because some subset of the population abuses theirs.

A writer I greatly admire, Rod Dreher, an independent-minded conservative, gives voice to such feelings in an article posted this weekend on the American Conservative website. Dreher expresses himself forcefully and frankly. That frankness should be welcomed, because the more clearly a mistaken idea is put, the faster we can reach a better understanding.

Dreher wrote:

"Yesterday the Baton Rouge Advocate published a lengthy analysis of the 2012 murder stats in the city. Take a look at this PDF of one of the inside pages. Last year, 83 people died by homicide in Baton Rouge. Of that number, 87% were black, and 87% were male. Two-thirds had been in trouble with the law before, and one-third had been in trouble with the law for drugs. The median age of victims: 26.

"Of the perpetrators, the median age was 22. Get this: 96% of them were black, and 90% were male. Almost two-thirds had previous arrests. One out of four had a drug record.

"Most of the murders took place in the poorest parts of the city.


"What can we learn from these statistics? That murder in Baton Rouge is almost entirely about young black men from the poor part of town killing other young black men from the poor part of town. It's mostly a matter of thugs killing thugs."

If you look at the world that way, gun control must seem a pointless diversion from the real problem: not guns, but one particular group of gun owners. Somebody else's problem. But life is not so neatly separated.

Yet the urge to subdivide runs strong among Americans. Monday on Fox News, the popular conservative commentator Ann Coulter claimed that the murder rate among white Americans is as low as the murder rate in Belgium. "So perhaps it's not a gun problem," she concluded. "Perhaps it's a demographic problem."

But countries cannot dismiss the sufferings of great blocks of their people by dismissing some "demographics" as unworthy of attention.

If you ignore America's poor, you can make all kinds of problems disappear from view. Not counting the poor and minorities, the country does not have an obesity epidemic. Not counting the poor and minorities, the United States has perfectly adequate schools. Not counting the poor and minorities, America would have a higher average income.

Likewise, not counting hurricanes, America would not have so many natural disasters. Not counting divorces, America would have more intact families. Not counting wars, America would have a smaller public debt. But what's the point of this exercise? The people who make up America count as Americans, and their problems count as America's problems. Their problems do not occur in isolation, but are manifestations of failures to which all Americans contributed together.

President Obama Announces 23 Gun Control Executive Orders - 1

As anticipated, President Barack Obama unveiled his sweeping gun control package Wednesday, only instead of issuing the anticipated 19 executive orders, he delivered 23 presidential fiats that include an assault weapons ban, outlawing ammunition clips that hold more than 10 bullets and requiring background checks for every gun buyer in America.

"While reducing gun violence is a complicated challenge, protecting our children from harm shouldn’t be a divisive one," Obama said during a White House press conference flanked by Vice President Joe Biden and four children who wrote to him in the aftermath of the Dec. 14 mass shooting at Sandy Hook Elementary School.

According to a fact sheet provided by the White House, it will cost an estimated $500 million to impose the new restrictions outlined in Obama's 23 executive orders.

Also as expected, Republicans responded to Obama's initiatives by crying foul, insisting the president is wielding dictatorial power he doesn't legally have.

"I'm against having a king," Sen. Rand Paul (R-Ky) said on the Sean Hannity show Tuesday night. "Someone who wants to bypass the Constitution, bypass Congress, that's someone who wants to act like a king or a monarch. We will fight tooth and nail and, I promise you, there will be no rock left unturned as far as trying to stop him from usurping the Constitution."

4 injured after firearms go off at N.C., Indiana gun shows

(CNN) -- At least four people -- three in North Carolina and one in Indiana -- were injured after weapons went off at gun shows Saturday, officials said, at a time when there's been renewed discussion about private gun sales at such shows.

Dixie Gun and Knife Show attendees bolted, with at least one woman wiping out in the frenetic scene, after gunfire rang out around 1 p.m., as seen on video captured by CNN affiliate WRAL.

Police later explained that a 36-year-old man from Wilmington, North Carolina, was unfastening the case of his 12-gauge shotgun on a table near the show entrance when it accidentally discharged. The man planned to sell the shotgun at the show.

The bird shot ended up injuring three people. One was a sheriff's deputy, who suffered a slight injury to his hand and was treated and released at a local hospital before returning immediately to work, said Joel Keith, chief of police of the North Carolina State Fair.

A 54-year-old woman from Benson, North Carolina, was being treated a wound to her right torso at a local hospital, and a 50-year-old man from Durham, North Carolina, was treated for an injured left hand, Keith told reporters.

"I want to emphasize that this is an accident," Keith said.

That said, Wake County sheriff's investigators and the local prosecutor will determine whether to file charges against the gun's owner, authorities said.

Sheriff Donnie Harrison said he was unsure whether it was legal to bring a loaded gun on state fairgrounds. However, when the state fair is held in October, it is illegal to bring a loaded gun to the fairground because of the large crowds, authorities said. :roll

"This is state property. That's something we're looking into," Harrison told reporters. "It's early right now."

The shooting prompted police to ban any private gun sales -- in which visitors bring their firearms to sell at the gun show -- for the remainder of the two-day show, which concludes Sunday, Keith said. He added there wouldn't be any private gun sales on fairgrounds for the indefinite future. :clap

The gun show was closed after the shooting and will reopen Sunday. At that point, show vendors can continue to sell firearms, which are already secured inside the show, Keith said.

"If we thought if it was a problem or a hazard, we wouldn't have this show," Keith said about private gun sales at the show. "I'm sure there isn't anybody who hates this more than the guy who owned this weapon."

Meanwhile, in Indianapolis, a man walking out of the Indy 1500 Gun and Knife Show shot himself in the hand as he was loading his .45-caliber semi-automatic firearm, Indiana State Police said in a statement.

The 54-year-old Indianapolis man was sent to Wishard Hospital for treatment after being "slightly" injured.

"The investigation determined the shooting to be accidental, and no charges will be filed," police said.

And in Ohio, a gun dealer in Medina was checking out a semi-automatic handgun he had bought Saturday when he accidentally pulled the trigger, injuring his friend, police said. The gun's magazine had been removed from the firearm, but one round remained in the chamber, police said.

Police Chief Pat Berarducci said it appears the bullet ricocheted off the floor and struck the friend in the arm and leg. The man was taken by helicopter to a hospital 30 miles north in Cleveland, Berarducci said. His condition wasn't immediately known.

Feds Investigating Felonious Gun Nut

How does a person convicted of manslaughter obtain 18 assault weapons and other firearms, along with 40,000 rounds of ammunition? Well, according to NBC News, a White Supremacist from Ohio who also happens to be a convicted felon did just that.

The arsenal was discovered during a completely separate arrest of 47-year old Richard Schmidt, who owns a sporting goods store called Spindletop Sports Zone where he was selling counterfeit jerseys and other sports goods from China. Initially, it was simply a check up on a thriving counterfeit goods market, but then search warrants were unveiled and Schmidt was indicted on charges of illegal possession of firearms.

Even more disturbing is what the search warrants unveiled, which was four trailers out back with automatic and semi-automatic weapons, bullet-proof body armor, high capacity magazines, and ammunition. Further, evidence of ties to the Neo-Nazi movement was discovered, as well as a “Jewish 500″ list, which is supposedly a roster of Jewish-owned businesses. Further, there was paraphernalia from “Waffen SS,” Adolph Hitler’s Nazi military force through World War II.

I could go on, but I think you get the picture. This, ladies and gentlemen, is why we need gun control. This guy is a nut not only for guns, but for Nazi ideology to boot. According to the report, he was possibly planning attacks against Jewish people and civil rights groups in the area. If he hadn’t been arrested for selling counterfeit sports goods, who knows how far this would have gone?

The Second Amendment Trump Card

Nothing happens in politics unless one side holds a trump card and can force the other side to compromise.

In this gun debate, President Obama has a powerful Second Amendment trump card. And, if there was ever a time to use it, it's now.

Oh, you didn't know such a card existed? Well of course you didn't. Because no one ever raises the issue. Here's the full text of the Second Amendment. Read it and see if you can identify the trump card part:

"A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed."

See it? It's right there in the beginning and the kicker is at the very end.

"A well regulated militia, being necessary to the security of a free state ..." and "... shall not be infringed ."

The part the NRA folk like best... "...the right of the people to keep and bear arms," is actually the shortest part of the Second Amendment.

Obama's trump card goes like this:
•The President of the United States of America is, constitutionally, also the nations "Command in Chief..." the guy in charge of the military. State governors are in charge of their state militias.
•Therefore, any national "militia" would be under the Commander in Chief's command. State militias would be under the command of State governors, which would then be responsible for their behavior -- or misbehavior.
•Such "militias" must, be, as demanded by the Second Amendment, "well regulated."
•And that regulation requirement, like the part of the sentence about there right to bear arms, "shall not be infringed," but only as long as the first part of these amendment is part of the deal.
•Right now all those gun-owners out there are supremely and utterly in violation of the the very first part of the Second Amendment - they are unregulated and increasingly unruly.
•Therefore, to wit, in order for gun-owners to claim protection under the Second Amendment they must be in full compliance with it. Full compliance, not partial.
•They are not in full compliance with it, and therefore cannot claim such protection.

Hello Barry? You in there?

If you are in there, call a news conference and tell the NRA, and their ilk, that they have a choice:

Either back sensible and effective gun regulation, or you declare gun-owners are operating outside the constraints clearly delineated in the Second Amendment. And that they must either join a recognized and well-regulated federal or state militia, or they will be forced turn in all semi-automatic weapons in their possession until they do join such a well-regulated militia.

Oh sure, all holy hell would break loose. But the President would have the words of the Second Amendment on his side.

The Right has become accustomed to using the US Constitution to claim whatever it believes are it's rights. Well, we can play that game too. The US Constitution is in black and white. It's a contract, not a suicide pact.

Since the Right likes to claim the US Constitution is infallible and must be taken literally, fine. Then they can't have it both ways.

The first 13-words of the Second Amendment has two parts, not just one: "A well-regulated militia" as a requirement to "keep and bear arms." If the framers didn't want it that way, they wouldn't have written it that way.

So, all you self-styled "patriots," either enlist in a state or federal militia, or hand over the heat.

Group of Second Amendment-Supporting Gun Makers Now Refusing to Sell Arms to Law Enforcement in New York (And Other Gun-Restricting States)

Since New York State enacted its restrictive new gun laws, many manufacturers have sent that state (and others) a message: If local governments are going to severely restrict the ability of citizens to own guns, then these companies will not be selling to law enforcement in those areas.

Among the gun manufacturers sending that message:

Obama Requests $1.1 Billion for Gun Control


President Obama has requested $1.1 billion and the Department of Justice (DOJ) asked for $382.1 million for gun control "to protect Americans from gun violence."

Included in the DOJ's $382.1 million figure is a request for $2 million for smart gun technology grants.

According to The Washington Beacon, Obama's $1.1 billion "[includes] $182 million to support the president's 'Now is the Time' gun safety initiative."

"Now is the Time" includes the following:

1. Require background checks for all gun sales.

2. Strengthen the background check system for gun sales.

3. Pass a new, stronger ban on assault weapons.

4. Limit ammunition magazines to 10 rounds.

5. Finish the job of getting armor-piercing bullets off the streets

6. Give law enforcement additional tools to prevent and prosecute gun crime

7. End the freeze on gun violence research

8. Make our schools safer with new resource officers and counselors, better emergency response plans, and more nurturing school climates.

9. Ensure quality coverage of mental health treatment, particularly for young people.
