Post IRS accused of stealing 60 million medical records
There are some articles on the IRS' alleged targeting of certain groups for investigation under the Active Mind, but this is a news item, so I am posting it here.

IRS steals 60 million medical records from California residents

The fourth amendment of the US Constitution is under continuous assault today from the very government that was assigned to defend it. The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, is being violated constantly now, without warrant, without probable cause, without oath and affirmation, and without proper description.

Recently, in California, 15 IRS agents were accused of raiding and stealing 60 million medical records from a California health insurance agency. This news is only adding fuel to fire as the IRS is coming under heavy scrutiny.

The health insurance agency that was raided and stolen from, identified in court as the "John Doe Company," said they warned the IRS before they came in and seized more than 60 million citizen medical records.

"In a case involving solely a tax matter involving a former employee of the company, these agents stole more than 60 million medical records of more than 10 million Americans," said Barnes. "No search warrant authorized the seizure of these records; no subpoena authorized the seizure of these records; none of the 10,000,000 Americans were under any kind of known criminal or civil investigation and their medical records had no relevance whatsoever to the IRS search."

Through further investigation, the IRS stole the company's entire IT system, searching through the company's most private information. ..... According to reports, an unnamed HIPAA-covered entity in California is suing 15 IRS agents, who now face a class action lawsuit. The lawsuit is citing punitive damages for constitutional violations and seeking compensatory damages of $25,000 "per violation per individual."

These medical records contained intimate and private information of more than 10,000,000 Americans, information that by its nature includes information about treatment for any kind of medical concern, including psychological counseling, gynecological counseling, sexual or drug treatment, and a wide range of medical matters covering the most intimate and private of concerns,” the complaint states.

“Despite knowing that these medical records were not within the scope of the warrant, defendants threatened to ‘rip’ the servers containing the medical data out of the building if IT personnel would not voluntarily hand them over,” the complaint reads.

“Moreover, even though defendants knew that the records they were seizing were not included within the scope of the search warrant, the defendants nonetheless searched and seized the records without making any attempt to segregate the files from those that could possibly be related to the search warrant. In fact, no effort was made at all to even try maintaining the illusion of legitimacy and legality.”

The IRS has not returned requests for comment.

I've said it before and I will say it again - it is time for a flat tax rate in the US. Ten percent for individuals and 15 percent for corporations with no exemptions. You could just file over the internet on a document the size of a standard W4 form.

This is exactly what we paid in Venezuela many, many years ago and it works.

But, NO, we need to subsidize state sponsored terrorism, federal employees spending millions on entertaining themselves, and the accounting industry.

:sheep

Thanks, Ruts, for bringing this forward. This is just shameful.

Its easier to fight the little guy than it is the Big Corporations because they have deep pockets and Lawyers who used to be politicians!

The little guy won't fight the IRS or CRA where the scum bag corporations will because they have the lawyer's all lined up and half the judicial system on their side.

We can't win, nuff said
